STREAM-CONCERN END USER LICENSE AGREEMENT Copyright (c) 2026 stream-concern LLC. All rights reserved. This End User License Agreement (the "Agreement") is a legal agreement between you (an individual or a single legal entity, "you") and stream-concern LLC ("stream-concern", "we") for the stream-concern software, including the desktop applications for macOS, Windows and Linux, the engine, the virtual camera components, the companion tools, the documentation and any updates, upgrades or new versions stream-concern makes available to you (together, the "Software"). By downloading, installing, copying or using the Software you accept this Agreement. If you do not accept it, do not install or use the Software. The Software is licensed, not sold. stream-concern and its licensors retain all right, title and interest in the Software, including all copyrights, trademarks and other intellectual property rights, except for the limited rights expressly granted below. 1. DEFINITIONS "Alpha Version" means any build of the Software that stream-concern labels as alpha, pre-release, preview, beta or test, including the builds offered on the stream-concern website before a Licensed Version exists. "Licensed Version" means a release of the Software that stream-concern offers against payment under a License Key or an account entitlement. "License Key" means the key, token or account entitlement stream-concern issues to you when you purchase a license. "Update Period" means the period of one (1) year starting on the date of your purchase, as recorded by stream-concern. "Updates" means every version of the Software, including bug fixes, feature releases and new versions, that stream-concern makes generally available during your Update Period. 2. ALPHA VERSIONS 2.1 Grant. stream-concern grants you a free, personal, non-exclusive, non-transferable, revocable license to install and use Alpha Versions for the purpose of evaluating and testing the Software and giving feedback. 2.2 Nature of an Alpha Version. Alpha Versions are works in progress. They may contain errors, may lose or corrupt data, may stop working, may change or remove features without notice, and may be withdrawn at any time. They are not intended for production use. You use them at your own risk. 2.3 Time limit. stream-concern may limit Alpha Versions in time in a later build: such an Alpha Version may, two (2) weeks after its release or at another interval stream-concern sets, tell you that it has expired and that a newer Alpha Version is available, and it may then stop accepting use until you install a newer build. An Alpha Version without such a limit keeps working. stream-concern may offer Alpha Versions with or without an account. 2.4 Beta. stream-concern may offer beta builds that require an account but no payment. Beta builds are Alpha Versions for the purposes of this Agreement. 2.5 Feedback. If you give stream-concern comments, suggestions or other feedback about the Software, you grant stream-concern a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without obligation to you. 3. LICENSED VERSIONS 3.1 Grant. When you purchase a license and receive a License Key, stream-concern grants you a perpetual, non-exclusive, non-transferable license to install and use the Licensed Version you purchased, and every Update released during your Update Period, on the number of devices your purchase states (one device per license unless your purchase says otherwise), for your own personal or internal business purposes. 3.2 Updates for one year. Your license includes access to all Updates released during the Update Period, which runs for one (1) year from the date of purchase. After the Update Period ends you need a new license to obtain Updates released after that date. 3.3 Your license does not expire. The Software versions you obtained during your Update Period remain licensed to you and CONTINUE TO WORK after the Update Period ends. An expired Update Period never disables, degrades or restricts a version you already hold. It only means that versions released after your Update Period are not licensed to you until you purchase a new license. 3.4 Expiry notice. The Software may tell you, starting about one (1) month before your Update Period ends, when it ends and how to renew. Such a notice never prevents the Software from working. 3.5 Pricing. The price and terms of a license are those shown by stream-concern at the time of purchase. stream-concern may change prices and terms for future purchases. 3.6 Accounts. stream-concern may require an account to purchase, activate or download Licensed Versions. You are responsible for keeping your account credentials and License Key confidential and for all use under them. 4. RESTRICTIONS Except as this Agreement expressly permits or applicable law requires, you may not, and may not permit anyone else to: (a) copy the Software other than for backup or as needed to install and use it under this Agreement; (b) sell, rent, lease, lend, sublicense, distribute, host as a service or otherwise make the Software or a License Key available to third parties; (c) modify, adapt, translate or create derivative works of the Software's proprietary components (this Agreement contains no prohibition of reverse engineering: see Section 5.2); (d) remove, alter or obscure any copyright, trademark or other proprietary notice in the Software; (e) circumvent or disable any License Key check, time limit, account check or other technical measure in the Software; or (f) use the Software in violation of applicable law or of the rights of any third party. 5. THIRD-PARTY AND OPEN-SOURCE COMPONENTS 5.1 The Software includes third-party components under their own licenses, listed in the file THIRD_PARTY_LICENSES.md distributed with the Software. Those licenses govern those components; nothing in this Agreement limits the rights they grant you. 5.2 FFmpeg and other dynamically linked LGPL libraries. This Software uses libraries from the FFmpeg project under the LGPLv2.1 (the GNU Lesser General Public License, version 2.1 or later): libavcodec, libavformat, libavutil, libswscale and libswresample, compiled with dynamic linking (--enable-shared --disable-static) and without any GPL-licensed component, and shipped as separate shared libraries that you may replace. stream-concern LLC does not own FFmpeg; FFmpeg is the work of the FFmpeg developers (https://ffmpeg.org), and the source code of the FFmpeg version shipped with the Software can be downloaded from the location given in THIRD_PARTY_LICENSES.md. On Linux the Software also links dynamically against the GTK 4 and libadwaita libraries installed on your system (LGPL-2.1-or-later), which it does not ship. Nothing in this Agreement prohibits reverse engineering; in particular you may modify and replace these libraries and reverse engineer the Software for debugging such modifications, as the LGPL provides. Neither the LGPL nor any other copyleft license extends to the Software's own components, and the Software includes no code licensed under the GNU General Public License (GPL). 5.3 OpenH264. The Software's software H.264 encoder uses the OpenH264 Video Codec provided by Cisco Systems, Inc. The Software does not ship that codec: on your request it downloads Cisco's unmodified binary module from Cisco's servers, verifies it and loads it dynamically, and Cisco's license terms for that module, shown to you before the download, govern it. Cisco's binary is licensed under the AVC Patent Portfolio License for the personal use of a consumer or other uses in which it does not receive remuneration to encode video in compliance with the AVC standard; no license is granted or implied for any other use, and additional information may be obtained from MPEG LA, L.L.C. (http://www.mpegla.com). Hardware encoders and the other codecs do not use OpenH264. 5.4 NDI. The Software's NDI output and input use the NDI runtime, which is the property of Vizrt NDI AB and is licensed to you by Vizrt under its own terms. The Software does not ship the NDI runtime: you download and install it from https://ndi.video, and the Software loads it dynamically when it is present. NDI is a registered trademark of Vizrt NDI AB. 5.5 Other components are listed, with their licenses, in THIRD_PARTY_LICENSES.md, including the Chromium Embedded Framework (BSD) used for web overlays, Syphon (macOS) and Spout (Windows). 5.6 Streaming, recording and interchange protocols and services the Software can connect to (such as RTMP destinations) belong to their respective owners and are subject to their terms. 6. UPDATES, DATA AND PRIVACY 6.1 stream-concern may make Updates available. Updates may be subject to additional or different terms, which will be presented with the Update. 6.2 The Software checks for Updates and, for Licensed Versions, validates your License Key with stream-concern. The Software does not send your stream keys, scenes, recordings or media to stream-concern. Any additional collection of usage or crash data is opt-in and described where it is offered. 7. TERM AND TERMINATION This Agreement is effective until terminated. It terminates automatically if you breach any of its terms. stream-concern may withdraw Alpha Versions at any time. On termination you must stop using the Software and destroy all copies. Sections 3.3 (for licenses in good standing), 5, 8, 9, 10 and 11 survive termination. 8. DISCLAIMER OF WARRANTY THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAM-CONCERN AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED OR COMPATIBLE WITH YOUR HARDWARE, CAPTURE DEVICES, ENCODERS OR STREAMING SERVICES. ALPHA VERSIONS IN PARTICULAR ARE EXPERIMENTAL AND MAY FAIL, INCLUDING DURING A LIVE STREAM OR RECORDING. YOU ARE RESPONSIBLE FOR BACKING UP YOUR DATA AND FOR TESTING THE SOFTWARE BEFORE RELYING ON IT. 9. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL STREAM-CONCERN OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, AUDIENCE, SPONSORSHIP, DATA, RECORDINGS OR STREAMS, OR FOR THE COST OF SUBSTITUTE SOFTWARE OR SERVICES, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. STREAM-CONCERN'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID STREAM-CONCERN FOR THE SOFTWARE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR, FOR AN ALPHA VERSION OR ANY OTHER FREE USE, TEN UNITED STATES DOLLARS (US$10). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE STREAM-CONCERN'S LIABILITY IS LIMITED TO THE GREATEST EXTENT THE LAW PERMITS. 10. EXPORT, GOVERNMENT USE AND COMPLIANCE You will comply with all applicable export control and sanctions laws. If you are a government entity, the Software is "commercial computer software" and is licensed with only those rights set out in this Agreement. 11. GENERAL 11.1 Governing law. This Agreement is governed by the laws of the State of California, United States of America, without regard to its conflict-of-laws rules. The courts located in that State have exclusive jurisdiction over any dispute arising out of this Agreement, and you consent to their jurisdiction. 11.2 Entire agreement. This Agreement, together with the terms presented at purchase and the third-party licenses referenced in Section 5, is the entire agreement between you and stream-concern about the Software and supersedes any prior agreement. 11.3 Changes. stream-concern may update this Agreement for future versions of the Software. The version of this Agreement distributed with a version of the Software governs that version. 11.4 Severability; waiver. If any provision of this Agreement is held unenforceable, the rest remains in effect and the provision is enforced to the greatest extent permitted. A failure to enforce a provision is not a waiver of it. 11.5 Assignment. You may not assign this Agreement or your license without stream-concern's written consent. stream-concern may assign this Agreement to a successor of its business. 11.6 Contact. stream-concern LLC, a California limited liability company. Questions about this Agreement or about licenses: contact@stream-concern.com, or through the stream-concern website.
